Eminent Domain

Eminent Domain refers to the power of the state to seize private land for its own use without the owner’s consent. The government must demonstrate that the land will be used for the “public good.” The U.S. government has typically used this power in order to complete public projects like the construction of roads and highways, though a controversial Supreme Court decision in June 2005 has paved the way towards using it for economic development, even when the land is being taken from one private owner and shifted to another private owner.  Cities have taken private land in order to make way for developers who then build more expensive homes and offices; the city justifies this by claiming the move increases the city’s tax base.  The government, under the 5th Amendment, is supposed to offer “just compensation” in return for the land, though this may be irrelevant to a family that has lived in the same home for generations.
